The court hearings of the court cases FOICA vs. “Ashtarak kat” CJSC and FOICA vs. “Daughter Marianna” Co. Ltd will take place accordingly on August 7, 2012, at 11:45 and on September 25 , 2012, at 16:30.

Let us remind, that on December 19, 2011, the FOICA applied to the RA Administrative court, because the “Ashtarak kat” CJSC had left unanswered the FOICA’s information request about the “Daughter Marianna” Co. Ltd’s had provided an unjustified response. It should be noted, that the “Ashtarak kat” CJSC answered to the information request after the FOICA applied to the court.

The FOICA asked to the court to obligate the abovementioned organisations providing the requested information and imposing an administrative penalty on the directors of the companies.

RA Administrative Court made ​​a decision to reject the adoption of the FOICA’s lawsuits finding that the claims are not subjects to the Administrative Court.

The FOICA appealed the decision of the Administrative Court. On March 5, 2012, the RA Administrative Court of Appeal satisfied the FOICA’s claim partially. The Court rejected the FOICA’s demand to obligate the organisations providing the requested information and satisfied the demand to imposing an administrative penalty on the directors of thecompanies. Thus, the RA Administrative Court adopted the FOICA’s lawsuits against the “Ashtarak kat” CJSC and “Daughter Marianna” Co. Ltd.
