CRITERIA FOR THE BLACK LIST

The Freedom of Information Center of Armenia annually publishes the “Black List” of those officials heading agencies that have violated the access to information right. The Black List includes the heads of central government, local self-government, and other state institutions, or heads of organizations of public importance that:

  • Do not respond to information requests,
  • Respond to information requests breaking the time frames defined by the RA “Law on Freedom of Information.” (While the “Law on Freedom of Information” defines a timeframe of 5 business days to respond to written requests, FOICA allows an additional 4 business days to allow time for postal delivery. Thus, a response is considered in violation of deadline if it is not received within nine business days after sending the information request. In case of electronic requests, FOICA considers 5 business days as in accordance with the law).
  • Do not provide proper justifications for denying a request.
  • Provide incomplete or false information,
  • Define and/or charge illegal fees for providing information.
  • Refer to improper information sources.
  • Do not properly publish information subject to mandatory publication in due times, in accordance with the RA “Law on Freedom of Information”, articles 3 and 7.

The head of the institution that violates the access to information right appears in the Black List because a) he or she represents that institution, both formally and practically; and b) the Law on Freedom of Information requires all public institutions to follow specified procedures and to uphold and promote the right of citizens to have access to public information, and as such, if the institution is not complying with the law, the ultimate responsibility rests with the official heading that institution.

In the past, the percentage of unanswered inquires was in the range of 30-36%. Currently, as the RA Law on Freedom of Information is in effect already for 17 years, this figure has improved significantly as a result of numerous trainings, litigations launched and public awareness campaigns organized by the FOICA: in 2020 the number of unanswered FOICA requests decreased more than 10 times, dropping to 3%, compared to 35% recorded in previous years.

The number of mute refusals has diminished, instead being replaced by largely incomplete or groundless replies or unjustified refusals. Thus, previously the officials tended to avoid providing information that could have shown their institution at a disadvantage and left the information requests unanswered. Currently, in response to “problematic” information requests the officials prefer to provide incomplete, evasive and unessential answers, rather than leaving them unanswered.

With all of this in mind, effective July 1, 2013 the FOICA introduces more rigorous criteria for blacklisting. Before including an official and the corresponding institution on the Black List, the FOICA takes the following steps:

STEP 1: After the deadline defined above is exceeded, the FOICA representative calls and checks whether the request was received and who is responsible for it. If the request is sent via the e-request electronic platform, FOICA follows the request only through the platform, and calls for corrections only if there are technical problems with the special code provided by the platform.

STEP 2: After receiving an incomplete answer, a groundless denial, or mute answer, the Center sends the second request.

STEP 3: After leaving the second request unanswered that specific body and its head appear in the Black List.

STEP 4: In exceptional cases, when it is clear from the content of the response to the request that the information holder may not have understood what information is expected, or has omitted the requested information as a result of obvious technical or acceptable response, the FOICA sends the second request to that body. In case of a negative answer, the head of the body holding the new information is included in the Black List.

The FOICA Black List is continuously updated. All those institutions that review their activities after being included in the quarterly Black List, and carry on reforms that improve information accessibility will be taken out of the Black List. The FOICA will note on its Black List page the progress made by such institutions.

Black List 2023

During 2023, the following state agencies and officials violated the constitutional right of people or organizations to access to information by providing unreasonable or incomplete responses, illegal denials, or leaving requests unanswered. The Black List is developed based on the following criteria.

During 2023, 70 information requests were registered on the FOICA’s online request platform. 86% of requests received a timely full response, 7% received a late full response. One percent of requests were given “unjustified rejection” and another percent received “unjustified response” status. 4% of requests remained unanswered.

  • Levon Hovhannisyan, first deputy mayor of Yerevan, acting mayor (17.03.2023-13.10.2023)

RA citizen Arsen Chalyan applied to the Freedom of Information Center of Armenia, asking for assistance in obtaining information. On July 3, 2023, he sent an information request to the Yerevan Municipality, asking to provide information on the procedure for returning the money confiscated as a result of an administrative penalty and transferred to the Yerevan Municipality. However, the Yerevan Municipality did not provide answers to the submitted questions in the written response. Citizen Chalyan sent another request on July 10, 2023 to which none of the questions were addressed in the letter received in response. On August 21, FOICA addressed the citizen’s questions to the Municipality, this time already on behalf of FOICA. However, the Municipality provided an unjustified response in a written form. Later, the Municipality provided the required information in response to the repeated request of the FOICA.

  • Samvel Arakelyan, Chief of Staff of the RA Constitutional Court

On July 7, 2023 the Freedom of Information Center of Armenia applied to the Constitutional Court, requesting to provide a copy of the reference submitted by the Ministry of Justice (or an active link providing access to the document). This document is mentioned in the Constitutional Court’s decision CCD-1175(ՍԴՈ-1175) in the case on determining the compliance of the obligations set forth in the agreement signed in Minsk on October 10, 2014 with the Constitution of the Republic of Armenia.
July 10, 2023, with official written response the Court refused to provide the requested information. The FOICA described the refusal of the head of the staff as unjustified and appealed by sending a repeat request, which remained unanswered.

  • “Civil Contract” party

On August 23, 2023, the FOICA sent an information request to the “Civil Contract” political party asking for information on the list of donors who donated money during the party’s fund-raising evening held before the Yerevan Council of Elders elections, as well as those who donated to the party during the fund-raising evening and information on the refund of donations exceeding the limit set by Article 24, Part 2 of the Constitutional Law on Parties. The request of the “infocom.am” news site became the basis for the FOICA request.

The party did not respond to the first request submitted by FOICA. It also left unanswered the second request for information addressed on September 11, 2023. As a result, FOICA’s right to access to information was violated.

On December 4, 2023, FOICA filed a lawsuit to compel the “Civil Contract” party to disclose information. On December 14, 2023, the Civil Court of First Instance of Yerevan accepted the FOICA’s claim (court case N: ED2/41477/02/23). Later, at the suggestion of the “Civil Contract” party, a reconciliation agreement was signed between the parties. On January 12, 2024, the Party provided all the required information to FOICA.

In 2021, the heads of following state bodies violated the constitutional right of individuals or organizations to receive information by providing baseless or incomplete answers, illegal denials or leaving requests unanswered. The Black list is drawn based on the following criteria.

  • Vagharshak Harutyunyan, Former Minister of Defence of the Republic of Armenia

On January 7, 2021 “PastInfo” news agency sent a request to the Ministry of Defence for information concerning martyred soldiers. Ministry answered the work is underway to determine the number of killed soldiers and consider it inexpedient to provide information. The refusal is considered baseless, as such statement for refusal is not provided by law.

  • Arshak Karapetyan, Former First Deputy Minister of Defense

On July 26, 2021 Ophelia Simonyan, the journalist from Media Initiatives Center sent a request to the Ministry of Defence asking how many servicemen have signed a contract with “I have honor” and “I am” programs from the beginning to the day of sending the request. The ministry refused to provide the information, describing it as an official secret. The refusal was considered baseless. Especially, since the Ministry provided a full answer to the inquiry of the same content sent to “Hraparak” newspaper in 2020.

  • Hayk Marutyan, Former Mayor of Yerevan

– On August 12, 2021 FOICA sent request to the Yerevan Municipality to provide information concerning activities of an illegally exploited stone factory and seizure of the land of the community near Yerevan, Silikyan old highway 60/1. The municipality provided baseless answer without actually answering the inquiry (http://www.givemeinfo.am/hy/case/3312/). The same issue continued with duplicated requests (https://www.foi.am/hy/all-cases/item/2136/), (http://www.givemeinfo.am/hy/case/3331/).

On August 30, 2021 FOICA applied to the Human Rights Defender. The Defender states that by not providing a proper, complete response to the Freedom of Information Center NGO President Shushan Doydoyan’s requests, the Yerevan Municipality violated her right to receive information stated by the RA Constitution, the RA Law on Freedom of Information, and international documents.

On November 1, 2021 FOICA appealed to the Administrative Court with a request to obligate Yerevan Municipality to provide a comprehensive response to the aforementioned inquiry.

– In 2021, Yerevan Municipality violated the right of the residents of Yerevan Physics District to get information. The Municipality didn’t appropriate inform citizens concerning construction of a 12-floor building.

  • Arsen Torosyan, Former Chief of Office to the Prime Minister of the Republic of Armenia.

A citizen Harutyun Tsatryan asked FOICA to support in getting information. On March 20, 2021 citizen sent a request to the Staff to the Prime Minister of the Republic of Armenia asking how many citizens of the Republic of Armenia went to the Russian Federation and how many RA citizens came to Armenia from Russian within the same period. The Prime Minister’s Office forwarded the request to the Civil Aviation Committee, which in a reply stated that they didn’t have such information.

On April 9, 2021 (http://www.givemeinfo.am/hy/case/3298/) FOICA sent a request to Staff to the Prime Minister of the Republic of Armenia, asking indicate which state body manages that information. The Office of Prime Minister refused to provide the required information, referring to Decision No. 884-N of June 22, 2006.   • Narek Zeynalyan, Former Chairman of the Standing Committee on Health Care and Social Affairs of the National Assembly of the Republic of Armenia (Now Zeynalyan is the Chairman of Standing Committee on Health Care)

On January 12, 2021 a citizen Mushegh Hovsepyan sent a request to the Standing Committee on Health Care and Social Affairs of the National Assembly of the Republic of Armenia concerning Commission’s monitoring of the implementation of the UN Convention on the Rights of Persons with Disabilities and the actions taken by the Commission in 2020. The chairman of the commission Narek Zeynalyan provided a baseless answer not related to the questions.

  • Alen Simanyan, The Speaker of the National Assembly of the Republic of Armenia

On August 2, 2021 the work of the National Assembly launched with severe restrictions on the movement of media representatives in the Parliament. There weren’t any normative-legal act adopted, which would be a basis for such actions. On the same day, August 2, when the restrictions were already applied, the relevant decision of the NA Speaker was published. All the observations of the professional community remained unanswered.

  • Gor Gevorgyan, Former Member of the National Assembly of the Republic of Armenia

On April 14, 2021 FOICA sent a request to Gor Gevorgyan, MP of the National Assembly of the Republic of Armenia, requesting to provide the list of legislative initiatives he (co)authored during his parliamentary activity, indicating their status as of December 31, 2021. The inquiry remained unanswered.

Քաղաքացի Ռուզաննա Ադանուլյանը դիմել էր Ինֆորմացիայի ազատության կենտրոն՝ խնդրելով աջակցել իրեն տեղեկատվություն ստանալու հարցում: 2019 թ.-ի փետրվարի 28-ին ԻԱԿ-ը դիմել էր ՀՀ ԱՆ Դատաբժշկական գիտագործնական կենտրոն՝ խնդրելով տրամադրել 2014 և 2015 թ.-ի երրորդ եռամսյակի (հոկտեմբերի 1-ից-դեկտեմբերի 1-ը) ընկած ժամանակահատվածների հաստիքացուցակը և անվանացանկը: Ստանալով թերի պատասխան ԻԱԿ-ը կրկնակի հարցմամբ 2019 թ.-ի հունիսի 17-ին դիմել էր ՀՀ ԱՆ Դատաբժշկական գիտագործնական կենտրոն՝ խնդրելով տրամադրել հարցվող տեղեկատվությունը: Ստանալով անօրինական մերժում, ԻԱԿ-ը դիմել էր Անձնական տվյալների պաշտպանության գործակալություն։ Վարույթի արդյունքում Գործակալությունը որոշում էր կայացրել հօգուտ ԻԱԿ-ի։ Ուստի դեկտեմբերի 12-ին ԻԱԿ-ը նոր հարցում է ուղարկել Կենտրոն՝ նույն տեղեկությունը ստանալու պահանջով։ ՀՀ ԱՆ Դատաբժշկական գիտագործնական կենտրոնը ուշացած արձագանքել էր նոր գրությամբ, որով մեկ անգամ ևս անօրինական մերժել էր տրամադրել պահանջվող տեղեկությունները։

Black List 2018

RA Government Staff, Chief of Staff – Eduard Aghajanyan

On 23 May, 2018 Freedom of Information Center of Armenia submitted an electronic request to the RA Government Staff asking to provide the list of the vacancies as well as the publication source. The Government staff provided unjustified answer in 7 work days. The answer is considered to be unjustified, since though the Government continued to make appointments, the body mentioned in the answer that no information on vacancies was available.  http://www.givemeinfo.am/en/case/2384/ 

On 14 September, 2018 Roza Khachatryan, a journalist of Yerkir.am online newspaper, submitted a request to the Office of RA Prime Minister asking why the name of Sofya Navasardyan was not mentioned in Staff section of the Prime Minister’s official website and why his decision on her appointment had disappeared from the list. The journalist asked to clarify if Sofya Navasardyan was still working. The Office of RA Prime Minister asked for 30 days to provide the information and has not provided any answer yet.  http://www.givemeinfo.am/en/case/2547/

On 26 September, 2018 Lusine Mkrtchyan, a journalist of Mediamax online newspaper, submitted a request to the Office of RA Prime Minister asking information on how much money was returned to the state budget as a result of the fight against corruption and shadow economy and what those means were destined for.  RA Ministry of Defense, Minister – Davit Tonoyan

On 23 May, 2018 Freedom of Information Center of Armenia submitted an electronic request to the RA Ministry of Defense asking to provide the budget execution financial statement for the 1st trimester of 2018. The Ministry has unjustifiably refused to provide any information. The answer of the Ministry of Defense is considered as illegal refusal, since the body asked for additional time for providing the information and refused to provide it 4 days later. According to FOI Law the refusal must be provided within 5 days and the additional time must be exclusively asked for to provide the information and not for justifying the refusal. http://www.givemeinfo.am/encase/2379/

On 23 May, 2018 On 23 May, 2018 Freedom of Information Center of Armenia submitted an electronic request to the Ministry asking to provide the list of the vacancies as well as the publication source. The answer of the Ministry is considered as illegal refusal, since firstly the Body asked for additional time and then, 3 days later, refused to provide the requested information.  According to FOI Law the refusal must be provided within 5 days and the additional time must be exclusively asked for to provide the requested information and not for justifying the refusal. http://www.givemeinfo.am/en/case/2395/

RA Ministry of Sport and Youth Affairs , Minister  – Gabriel Ghazaryan

On November 6, 2018 Freedom of Information Center of Armenia submitted an electronic request to the Ministry asking to provide information on the results of the investigation carried out by the law enforcement bodies in Youth Events Center State Non-Profit Organization. The Ministry provided unjustified answer in 11 days, informing that the investigative activities were still in the process. http://www.givemeinfo.am/en/case/2487/

On November 6, 2018 Freedom of Information Center of Armenia submitted an electronic request to the Ministry asking to provide information on the grounds for the dissolution of Youth Events Center State Non-Profit Organization. In the answer provided in 11 days the Website for Publication of Legal Acts was mentioned as the source of the information, where the dissolution decision project was publicized, while the employees had receive a notifications on the dissolution a few weeks before publicizing the project. http://www.givemeinfo.am/en/case/2486/

On 15 August, 2018 Freedom of Information Center of Armenia submitted an electronic request to the Ministry asking to provide information on the grants and subsidies provided to NGOs out of the state budget. The refusal of the Ministry was regarded unjustified, since the information cannot be considered as a state / official, or banking and commercial secret. Mr. Samvel Tadevosyan – the Minister of Urban Development

On April 3, 2013 the Freedom of Information Center sent an information request to the RA Ministry of Urban Development, asking to provide the copies of the procurement contracts signed by the Ministry. The Ministry provided an unjustified refusal, claiming that the contracts contain trade secret of the companies whom contracts were signed with.

On June 24, 2013 the FOICA sent another request to the RA Ministry of Urban Development mentioning than the refusal was unjustified and once again asking to provide the copies of the procurement contracts. But the Ministry again provided an unjustified refusal, as the Ministry provided some information about the signed contracts, but again failed to provide copies of contracts. It should be noted that the Ministry has answered that it has signed 19 contracts, and 4 out of these 19 contracts are published on the RA Governments’ website www.e-gov.am Therefore, it is unclear if some of the requested documents have been published, then why are they considered a trade secret upon request.

Mr. Hovik Abrahamyan – the Speaker of the RA National Assembly

On November 22, 2012, the Freedom of Information Center sent an information request to the RA National Assembly, asking to provide provide the copies of the instructions by the Speaker of the RA NA. The NA provided an incomplete answer: 12 copies of the instructions by the Speaker of the RA NA were not provided. On March 7, 2013, the FOICA sent another request to the RA National Assembly asking to provide the missing 12 copies of the instructions. But NA provided an unjustified refusal, claiming that the instructions contain the NA employee’s personal data.

White List 2012

Starting from 2011 the Freedom of Information Center publishes the annual White List. All those information holders, which after being included in the FOICA’s quarterly Black list reviewed their activities in the FOI field and carried out reforms in order to ensure access to information, have not been included in the annual Black list of the officials who have violated the people’s access to information right. These information holders and their heads are now involved in the FOICA’s annual White list.

Mr. Levon Khalikyan – Head of the State Inspectorate for Surveillance of Markets of the RA Ministry of Economy

The head of the State Inspectorate for Surveillance of Markets of the RA ministry of Economy Levon Khalikyan appeared in the FOICA’s Black list of 4-rd quarter, 2012. FOICA applied to the Head of the State Inspectorate for Surveillance of Markets Levon Khalikyan with the request, asking to inform where and with what procedure the State Inspectorate for Surveillance of Markets publishes information subject to mandatory publication in accordance with part 3 of Article 7 of the law of the RA “On Freedom of Information”. In response to the request, the State Inspectorate has sent a letter which reads that the necessary information has been posted on the website of the Ministry of Economy at: www.mineconomy.am. However, there was no information at the website.

Thus, the FOICA applied on 20.11.2012 to the RA Minister of Economy, asking to ensure, within a reasonably short period but no more than during seven days, that the information related to the State Inspectorate for Surveillance of Markets and prescribed by part 3 of Article 7 of the Law be posted on the website of the RA Ministry of Economy. As of December 3, 2012, the summary reports of 2011 and 2012, the documents necessary during checkups, guidance for filling out checklists, address, phone numbers of the Inspectorate as well as legislative package within which the State Inspectorate for Surveillance of Markets works are now posted on the section of the aforementioned agency on the official website of the RA Ministry of Economy.

Mrs. Anahit Vardanyan – Director of the School N4 after Levon Shant

Director of the School N4 after Levon Shant Mrs. Anahit Vardanyan appeared in the FOICA’s Black list of 3-rd quarter, 2012. On August 17, 2012, the FOICA sent an information request to the Director of the School N4 after Levon Shant asking to provide information about the documents required for admission to the school. The request was left unanswered. Thus, on September 12, 2012, the FOICA sent the second information request, which also was left unanswered. After appearing in the Black list Mrs. Vardanyan provided the whole requested information also promising to work transparently and oppenly in the future. Taking into consideration the efforts of Mrs. Vardanyan to eliminate the violation of the freedom of information she was not included in the FOICA’s annual Black list and appeared in the White list 2012.

On February 21, 2012, the Freedom of Information Center sent an information request to the Mayor of Vardenis asking to provide information about the money allocated and provided by Vardenis city budget for snow cleaning works. The Mayor of Vardenis left the FOICA’s request unanswered. Thus, on March 15, 2012, the FOICA sent the second request with the same content. But the second request also was left unanswered.

Mr. Samvel Darbinyan – Mayor of Vanadzor

On February 21, 2012, the Freedom of Information Center sent an information request to the Mayor of Vanadzor asking to provide information about the money allocated and provided by Vanadzor city budget for snow cleaning works. The FOICA’s request remained unanswered. Thus, on March 15, 2012, the FOICA sent the second request with the same content. But the second request also was left unanswered.

Mr. Serge Sargsyan – President of the Republican Party of Armenia

On May 25, 2012, the Freedom of Information Center sent an information request to the Republican Party of Armenia asking to provide information about the event organized by the Republican Party on May 4, 2012, at the Republic Square in Yerevan. The Party has left unanswered the FOICA’s information request. Thus, the FOICA sent the second information request, which also was left unanswered.

On April 25, 2012, the Freedom of Information Center of Armenia sent an information request to the “Prosperous Armenia” Party asking to provide information on finances spent for pre-electoral campaign. The Party has left unanswered the FOICA’s information request. Thus, on May 16, 2012, the Freedom of Information Center sent the second information request to the “Prosperous Armenia” Party. The FOICA’s second information request also was left unanswered.

On April 25, 2012, the Freedom of Information Center of Armenia sent an information request to the “Armenian National Congress” Pact asking to provide information on finances spent for pre-electoral campaign. The Pact has left unanswered the FOICA’s information request. Thus, on May 16, 2012, the Freedom of Information Center sent the second information request to the “Armenian National Congress” Pact with the same content. However, the second request also was left unanswered.

On April 25, 2012, the Freedom of Information Center of Armenia sent an information request to the Democratic Party of Armenia asking to provide information on finances spent for pre-electoral campaign. The Party has left unanswered the FOICA’s information request. Thus, on May 16, 2012, the Freedom of Information Center sent the second information request to the Democratic Party of Armenia. The FOICA’s second information request also was left unanswered.

Mr. Viktor Martirosyan – Director of the “Environmental Program Implementation Office” State Institution

On May 29, 2012, the FOICA sent an information request to the Director of the “Environmental Program Implementation Office” State Institution Victor Martirosyan asking to provide information about the rewards (bonuses, gifts) received by the employees of the State Institution. An incomplete answer was received from the “Environmental Program Implementation Office” SI; no information asked by FOICA was received about the employees of the “Environmental Program Implementation Office” SI having received rewards and the amount of money. Thus, on June 20, 2012, the FOICA sent the second information request asking to provide complete and full information. The second request got an unjustified refusal with the grounding that it was information on personal data of the employee.

Mrs. Sona Gharibyan – Head of the Financial Oversight Inspectorate

On May 29, 2012, the FOICA sent an information request to the Head of the Financial Oversight Inspectorate Sona Gharibyan asking to provide information about the rewards (bonuses, gifts) received by the employees of the Inspectorate. In response to FOICA’s request, an incomplete answer was received. The answer was considered incomplete since no information requested by FOICA was provided about those employees of the Financial Oversight Inspectorate having received rewards and the amount of rewards received by each employee. Thus, on June 23, 2012, the FOICA sent the second information request asking to provide complete and full information. The second request got an unjustified refusal with the grounding that it was information on personal data of the employee.

On May 29, 2012, the FOICA sent an information request to the Head of the Licensing Agency Karen Tamazyan asking to provide information about the rewards (bonuses, gifts) received by the employees of the Agency. In response to FOICA’s request, an incomplete answer was received. The answer was considered incomplete since no information requested by FOICA was provided about those employees of the Licensing Agency having received rewards and the amount of rewards received by each employee. Thus, on June 23, 2012, the FOICA sent the second information request asking to provide complete and full information. The second request got an unjustified refusal with the grounding that it was information on personal data of the employee.

Mr. Karen Khtryan – Head of the Legal Act Expertise Agency

On May 29, 2012, the FOICA sent an information request to the Head of the Legal Act Expertise Agency Karen Khtryan asking to provide information about the rewards (bonuses, gifts) received by the employees of the Agency. In response to FOICA’s request, an incomplete answer was received. The answer was considered incomplete since no information requested by FOICA was provided about those employees of the Licensing Agency having received rewards and the amount of rewards received by each employee. Thus, on June 23, 2012, the FOICA sent the second information request asking to provide complete and full information. The second request got an unjustified refusal with the grounding that it was information on personal data of the employee.

On May 29, 2012, the FOICA sent an information request to the Head of the State Food Security Service Abram Bakhchagulyan asking to provide information about the rewards (bonuses, gifts) received by the employees of the Service. In response to FOICA’s request, an incomplete answer was received. The answer was considered incomplete since no information requested by FOICA was provided about those employees of the Licensing Agency having received rewards and the amount of rewards received by each employee. Thus, on June 23, 2012, the FOICA sent the second information request asking to provide complete and full information. The second request was left unanswered.

Mr. Andranik Gevorgyan – Head of the “Environmental Program Implementation Office” State Institution

On May 29, 2012, the FOICA sent an information request to the Head of the “Environmental Program Implementation Office” State Institution Andranik evorgyan asking to provide information about the rewards (bonuses, gifts) received by the employees of the SI. In response to FOICA’s request, an incomplete answer was received. The answer was considered incomplete since no information requested by FOICA was provided about those employees of the SI having received rewards and the amount of rewards received by each employee. Thus, on June 23, 2012, the FOICA sent the second information request asking to provide complete and full information. The second request was left unanswered.

 Mrs. Lilya Vardgesyan – Director of the School N1 after Stepan Shahumyan

On August 17, 2012, the FOICA sent an information request to the Director of the School N1 after Stepan Shahumyan asking to provide information about the documents required for admission to the school. The request was left unanswered. Thus, on September 12, 2012, the FOICA sent the second information request, which also was left unanswered.

Mrs. Ira Hakobyan – Director of the School N2 after Khachatur Abovyan

On August 17, 2012, the FOICA sent an information request to the Director of the School N2 after Khachatur Abovyan asking to provide information about the documents required for admission to the school. The request was left unanswered. Thus, on September 12, 2012, the FOICA sent the second information request, which also was left unanswered.

White List 2011

Starting from 2011 the Freedom of Information Center publishes the annual White List. All those information holders, which after being included in the FOICA’s quarterly Black list reviewed their activities in the FOI field and carried out reforms in order to ensure access to information, have not been included in the annual Black list of the officials who have violated the people’s access to information right. These information holders and their heads are now involved in the FOICA’s annual White list.

  •  Mr. Harutyun Kushkyan – The RA Ministry of Healthcare

Harutyun Kushkyan didn’t answer to the 07.02.2011 request of the FOICA. By this request the FOICA has asked the following information: 1. Does the Ministry have any documents that were declassified in 2010? 2. If yes, please, provide copies of those documents.

After being included in the FOICA’s Black list the Ministry of Healthcare provided a full answer to the FOICA’s information request. Besides, the employee of the Ministry, because of whom the Ministry was included in the Black list, got a reprimand. In addition, Mr. Harutyun Kushkyan publicly announced that they would be consistent, so that the information would always be provided within the defined time frames. FOICA’s further monitoring showed that in the FOI field the situation in this Ministry was reformed.

  •  Sargis Kharaqeshishyan – Mayor of Stepanavan

Sargis Kharaqeshishyan didn’t answer to the FOICA’s 18.04.2011 request. He didn’t provide the copy of a decision of the Stepanavan Council of Elders, by which was defining a payment for information provided by the Stepanavan municipality: 500 AMD for 1 page.

After being included in the FOICA’s quarterly Black list Stepanavan Council of Elders made void its decision by which a payment for information provided by the Stepanavan municipality was defined 500 AMD for 1 page. The Stepanavan municipality also provided a full answer to the FOICA’s request.

Black List 2011

These officials have violated the people’s access to information right in 2011

  • Mr. Armen Yeritsyan – The RA Minister of Emergency Situations

On October 19, 2011, the Freedom of Information Center sent an information request to the RA Ministry of Emergency Situation asking to provide the following information: 1. Does the Ministry have any documents that were declassified in 2010? 2. If yes, please, provide copies of those documents. This was the second request with the same content, as the Ministry didn’t answer the FOICA’s request of March 29, 2011. The second request also remained unanswered. As an answer to the FOICA’s 07.02.2011information request about the declassified documents the RA Ministry of Emergency Situations made a reference to the RA Special Investigatory Service, noting that the asked documents were confiscated by the SIS. But The Special investigatory Service informed the Freedom of Information Center that the copies of the confiscated documents were left in the Ministry of Emergency Situation. In other words, the Ministry of Emergency Situation is considered to be the information holder in this case. Thus, on March 29, 2011, the Freedom of Information Center once again sent an information request to the Ministry asking to provide the abovementioned information, but the FOICA’s request was left unanswered.

The RA Minister of Emergency Situations also left the FOICA’s 25.05.2011 request unanswered, where the Freedom of Information Center of Armenia was requesting for information whether there were documents under the Ministry’s possession, which were made declassified in 2010, and if there were any then the Ministry was asked to provide their copies.

  • Mr. Seyran Ohanyan – The RA Minister of Defense

On 20 May, 2011 student Lilit Sedrakyan had sent a written inquiry to the Minister, asking for information about the number of soldiers that for different reasons died in ARM detachments in 2010-2011, and what steps are taken to avoid such incidents. The student’s inquiry was left unanswered. On 22 June, 2011 the FOICA sent the same request to Minister Seyran Ohanyan, which was also left unanswered.

  • Mr. Arthur Gevorgyan – Head of the Information and Public Relations Department of Yerevan Municipality

Arthur Gevorgyan did not answer to journalist Arman Gharibyan’s 23.06.2011 information request that was sent to the official e-mail address of Yerevan municipality. With this request the journalist was asking how many kindergartens are currently operating in Yerevan and how many had been closed since 2000. By the way, the journalist had called and checked that the request had been received.

  • Mr. Sasun Safaryan – Head of village Aygedzor

On May 10, 2011, the Freedom of Information Center sent an information request to the Aygedzor rural community asking to provide the copies of the protocols of the Aygedzor Council. The rural community left FOICA’s request unanswered. Thus, on September 14, 2011, the FOICA sent the second request with the same content. The FOICA’s second request also remained unanswered.

On November 7, 2011, the FOICA sent written information requests to the “Ashtarak Kat” CJSC asking to provide information on the production of the “Ashtarak Kat” CJSC. The FOICA’s request remained unanswered.

  • Mr. Tigran Vardanyan – Director of “Daughter Marianna” Co. Ltd

On November 7, 2011, the FOICA sent written information requests to the “Daughter Marianna” Co. Ltd asking to provide information on the production of the “Daughter Marianna” Co. Ltd. The organization left FOICA’s request unanswered. Thus, the FOICA sent the second request with the same content. The “Daughter Marianna” Co. Ltd provided an incomplete and unjustified late response to FOICA’s second request.

  • Mr. Boris Makichyan – Rector of the Northern University

The Northern University left unanswered student Hripsime Hovhannisyan’s 17.03.2011 information request. By this request the student asked if there were made any repair works in the Northern University in 2010, and if so, how much money was spent. On March 29, 2011, the FOICA sent an information request for Hripsime Hovhannisyan with the same content, but the Northern University left also the FOICA’s request unanswered.

  • Mr. Arman Khachaturyan – Chief Executive Director of “HayPost” CJSC (ex-director)

On 12 October, 2010 president of “Marshal Baghramyan County” Robert Mkrtchyan turned to Arman Khachaturyan, but has not yet received an answer from him. On 26 May, 2011 the Freedom of Information Center of Armenia sent an information request asking in what stage was president of “Marshal Baghramyan County” Robert Mkrtchyan’s request and when it will be answered. This request was also left unanswered.

  • Mr. Armen Tadevosyan – President of “Hamalsaranakanner” condominium

Armen Tadevosyan did not answer to the FOICA’s 13.06.2011 request about the activities of the county. The FOICA’s 30.06.2011 double request was also left unanswered. On June 13, 2011, the FOICA sent a written information request On August 6, 2011, the FOICA sent a written information requests to “Hamalsaranakanner” condominium asking to provide information on maintenance of the Tsarav Aghpyur 55/5 building, as well as asking for a copy of the “Hamalsaranakanner” condominium statue. The FOICA’s request remained unanswered.

  • Mr. Armen Mesropyan – President of “Eryak” condominium

On August 6, 2011, the FOICA sent a written information requests to “Eryak” condominium asking to provide information on the activities of the condominium. The condominium left FOICA’s request unanswered.

  • Mrs. Vardush Kinkladze – President of “H & H” condominium

On August 6, 2011, the FOICA sent a written information requests to “H & H” condominium asking to provide information on the activities of the condominium. The FOICA’s request remained unanswered.

  •  Mrs. Karine Khachatryan – President of “Avan” condominium

On August 6, 2011, the FOICA sent a written information requests to “Avan” condominium asking to provide information on the activities of the condominium. The condominium left FOICA’s request unanswered.

By the way, The FOICA has filed lawsuits against four officials out of the Freedom of Information Center’s annual Black list to receive the requested information. These court cases are: FOICA vs. the RA Ministry of Emergency Situations, FOICA vs. “Hamalsaranakanner” (“Universitiers”) Condominium, FOICA vs. “Ashtarak kat” CJSC and FOICA vs. “Daughter Marianna” Co. Ltd.

During 2022, the following state agencies and officials violated the constitutional right of people or organizations to access to information by providing unreasonable or incomplete responses, illegal denials, or leaving requests unanswered. The Black List is developed based on the following criteria.

During 2022, 162 information requests were registered on the FOICA’s online request platform. 79.6% of requests received a timely full response, 2.5% of requests were given “unjustified rejection” and 3.1% “unjustified response” status.  All requests received a response. None was left unanswered.

 

  • Suren Papikyan, Minister of Defense 

On September 29, 2022, the Freedom of Information Center of Armenia submitted an information request to the Ministry of Defense, seeking information on the number of combat positions lost due to Azerbaijan’s recent military aggression against Armenia, as well as the list of servicemen and civilians killed in the war. On October 3, 2022, the Ministry of Defense requested additional time to provide the information. However, 16 days later, on October 19, it ultimately refused to disclose the requested information. This response is deemed illegal because, regardless of the justification for the refusal, it violates the legally established procedure for issuing such refusals, which mandates a response within 5 days. The additional time must be exclusively asked for to provide the requested information and not to justify the refusal.

  • Armen Abazyan, Director of the National Security Service of the Republic of Armenia

On October 17, 2022, the Freedom of Information Center of Armenia submitted an information request to the National Security Service, seeking information on the number of telephone conversations surveilled by the National Security Service during 2021. In the official written response, the NSS refused to provide the information, stating, ‘ NSS does not keep statistics of individual telephone conversation recordings, as they are destroyed after the expiration of the relevant court decision in accordance with current legal regulations.’ This response is considered unjustified, as the regulation requiring the destruction of recordings cannot serve as a sufficient condition and reason for not maintaining statistics on the recordings. Additionally, it is important to note that the FOICA specifically requested only quantitative data, which does not fall under the category of information subject to destruction.

  • Nazeli Baghdasaryan, the Shirak Region (Marz) Governor

On October 7, 2022, the Freedom of Information Center of Armenia submitted an information request to the Shirak region, requesting to provide the act and professional conclusion of the results of the audit inspection conducted in 2018 by the order of the Shirak Region Governor at School No. 32 in Gyumri. The official response stated that the Shirak Region office did not hold the requested information. According to Article 9, Part 10 of the RA Law “On Freedom of Information”, “If the information holder does not have the requested information, or its provision is beyond his authority, then after receiving the given written request, within 5 days, it is obliged to inform the applicant in writing about this, and if possible, also provide him with the information of the owner (including (archive) location that has the requested information.”

At the same time, the Staff of the Shirak region referred to the provisions of the RA Laws “On Internal Audit” and “On Accounting” and noted that the information contained in accounting documents, registers, and reports prepared for internal use are commercial secrets. According to the official response, the Staff of the Shirak region does not hold the information sought by the request, but at the same time informs that this information is a trade secret, from which it becomes clear that the Shirak Region office possesses this information, but it unjustifiably refuses to provide it.

  • Hrachya Sargsyan, Mayor of Yerevan

On February 11, 2022, the “Taxpayers Protection” NGO submitted an information request to the Yerevan Municipality, seeking information on administrative offenses in 2020 and 2021 under Article 124.7, Part 1 of the Code of Administrative Offenses. The request specifically asked for details on the number of cases and amounts (including court costs) paid to appellants in connection with complaints upheld because of the appeal. The response was deemed unjustified because it refused to provide information on the number of compensated cases and amounts without proper justification. Instead, it suggested appealing to the administrative court to obtain the required information.
