FOICA won the lawsuit against the National Assembly

On October 28, 2013 FOICA won the lawsuit against the RA National Assembly about obliging to provide information. The RA Administrative Court upheld the FOICA’s lawsuit obliging the National Assembly to provide the information lying in the basis of the case.

Note that the Freedom of Information Center had applied to the RA National Assembly on November 22, 2012 with a written request to receive information on providing the copies of the decrees of the President of the RA NA of the first half year of 2012.

However, the NA has provided an incomplete answer: the NA had presented the decrees of the President of the RA NA of the first half year of 2012 according to the serial numbers and failed to present the copies of 12 decrees. On March 7, 2013 FOICA applied to the NA again, requesting to provide also the copies of the missing decrees. However, the NA refused to present them, arguing that those particular decrees contained personal data on employees.

On April 8, 2013 the Freedom of Information Center filed a suit to the RA Administrative Court against the RA National Assembly, appealing the NA’s refusal. As a result, the Administrative Court made a verdict on December 28, 2013, therby sustaining the FOICA’s suit.
