The FOICA won the court case against the Zartonk Village Municipality, which lasted 3 years.

On December 12, 2012, the RA Administrative court fully satisfied the FOICA’s claim against Zartonk Village Administrator and the Village Administration considering the actions of a local self-governance body as unlawful and obliging to compensate the state fees paid by the FOICA at the amount of 24.000 AMD. The court case lasted more than 3 years.

On March 20, 2009, the FOICA filed a lawsuit at the RA Administrative Court against Zartonk Village Administrator and the Village Administration, as the latter had left unanswered the FOICA’s written request dated 07.02.2009, by which the FOICA had asked to provide the 2008 budget of the Zartonk community and a copy of the Zartonk community 2008 budget implementation report.  The FOICA applied to the court with 3 demands – to oblige the Village Municipality to provide the requested information, to imposing a 50,000 AMD administrative fine on the mayor of Zartonk and to consider the Zartonk mayor’s inaction as unlawful.

The Zartonk Administrator provided the requested information during the court case. Thus, the FOICA withdrew the part of the lawsuit asking to require the mayor to provide information and to impose a 50,000 AMD administrative penalty. However, the FOICA insisted on the request to consider the Zartonk mayor’s inaction as unlawful.

On August 13, 2009, the RA Administrative court decided to reject the FOICA’s abovementioned demand and to dismiss the case against the mayor of Zartonk. It is worth to note that this was the first time that the RA Administrative Court denied the claim to consider inactions of a local self-governance body as unlawful. Many of the FOICA’s lawsuits with similar claims have been satisfied by the RA Administrative Court.

On September 15, 2009, the FOICA filed a cassation claim against the RA Administrative Court’s decision. On April 22, 2010, the RA Court of Cassation annulled the RA Administrative Court’s decision and sent it to a new investigation. As a result, on December 12, 2012, examining the FOICA’s claim against the Zartonk Administration about considering the inactions of the mayor of Zartonk as unlawful the RA Administrative court fully satisfied the FOICA’s claim.
