On December 4, 2023, the Freedom of Information Center of Armenia (FOICA) initiated legal proceedings by filing a lawsuit to compel the "Civil Contract" party to disclose information.
The Human Rights Defender of the Republic of Armenia confirmed the fact of violation of the Freedom of Information Center's right to receive information by the Yerevan Municipality.
Media Defence has today filed a case at the Strasbourg court on behalf of four Armenian citizens following the bombing of the town of Martuni by Azerbaijani forces during the recent armed conflict in Nagorno-Karabakh. The applicants - three journalists who were injured and the brother of a journalist fixer who was killed - allege that as a result of this attack their rights under the European Convention on Human Rights were violated by Azerbaijan.

35. FOICA vs. “Prosperous Armenia” Party

On April 25, 2012, the Freedom of Information Center of Armenia sent an information request to the president of the “Prosperous Armenia” Party Mr. Gagik Tsarukyan asking to provide information on finances spent for pre-electoral campaign.

The Party has left unanswered the FOICA’s information request. Thus, on May 16, 2012, the Freedom of Information Center sent the second information request to the “Prosperous Armenia” Party  asking to provide the abovementioned information. The FOICA’s second information request also was left unanswered.

As a resualt, on June 19, 2012, tha FOICA applied to the First Instance Court of the General Competence of Arabkir and Qanaqer-Zeytun administrative districts asking to oblige the “Prosperous Armenia” Party to provide the requested information within 5 days. The first court hearing was dated on September 12, 2012. It should be mentioned, that before the court hearing the “Prosperous Armenia” Party has provided the whole asked information and has asked the court to discontinue the case.

Thus, the FOICA applied to the court mentioning that FOICA had no objection if the Court discontinues the court case with condition, that either the court should solve the issue of compensation of the legal expenses made by FOICA, or the Party should compensate the made legal expenses on its own initiative. The court case dated on 12 September, 2012, was postponed, as the representative of the FOICA was out of country.

Before the next court hearing the “Prosperous Armenia” Party has compensated the legal expenses made by the FOICA on its own initiative. Thus, at the court hearing which took place on October 2, 2012, the Court decided that the case FOICA vs. “Prosperous Armenia” Party should be discontinued. The decision of the Court was made on October 10, 2012.
